1. The title update — what it actually means
Because you already own the property, the title search on a refinance is called a title update (sometimes a "bring-down" or "search-down"). The title company pulls the public record from the date of your original owner's title insurance policy forward to today, looking for anything that may have attached to the property since you bought it:
- New mortgages, equity lines, or HELOCs
- Mechanic's liens from contractors
- HOA assessment liens or unpaid dues
- Tax liens (federal, state, or county)
- Judgments against you or any co-owner

On 30A, the most common surprise on a refinance title update is an unreleased prior mortgage — the loan was paid off years ago but the satisfaction was never recorded. The title company tracks down the prior lender and clears it before the new loan funds.
2. Why lender's title insurance is required on every refinance
Even though you already own the property and may have an owner's title insurance policy from when you bought it, the new lender requires its own lender's title insurance policy. The reason: the lender's prior policy (from your original purchase loan) is paid off and terminated when that loan is paid off. The new mortgage needs new lender coverage to insure the new loan amount and the new lender's lien position.
Florida lender's policies on refinances are issued at the reissue rate — typically about 30% lower than the original purchase rate — when the prior owner's policy was issued within the last few years. 3. The 3-business-day right of rescission — primary residences only
Federal law (Truth in Lending Act, Regulation Z) gives owners refinancing a primary residence a three-business-day right to rescind the loan after signing. The clock starts the day after closing, and the loan does not fund — and the new mortgage is not recorded — until the rescission period expires. Saturdays count as business days for rescission; Sundays and federal holidays do not.
This is why refinances on a primary residence take longer to fund than a purchase. You sign on Monday, the rescission period runs Tuesday through Thursday, and funds disburse Friday.
4. Why investment and vacation rental refinances close faster
The right of rescission applies only to a borrower's principal dwelling. Refinances on:
