    Selling a home on 30A is more than handing over the keys. The title company is the neutral party that makes sure your mortgage gets paid off correctly, your HOA dues are reconciled, the deed is properly drafted and recorded, FIRPTA withholding (if any) is handled with the IRS, the buyer’s funds clear before you sign the deed, and your net proceeds are wired to the right account the same day.     1. Title commitment and exception clearance

    The day we receive your contract, AquaRK orders a Walton County title search and issues a title commitment to the buyer. Anything that needs cure work — old unreleased mortgages, contractor liens, judgments — comes back to us as the seller’s title company to resolve.     If the seller is a "foreign person" under federal tax law (non-US individual, foreign corporation, foreign LLC), the buyer is required to withhold 15% of the gross sale price at closing and remit it to the IRS within 20 days. AquaRK calculates the withholding, prepares Form 8288/8288-A, files with the IRS on the buyer’s behalf, and provides the seller a stamped 8288-A for their tax filing. Many foreign 30A sellers also apply for a withholding-reduction certificate before closing — AquaRK can refer Florida tax counsel to file this.

    5. Deed preparation

    Florida law requires deeds to be prepared by a licensed Florida attorney. AquaRK is attorney-supervised and prepares your deed — almost always a general warranty deed for resale 30A transactions, sometimes a special warranty deed if the seller is a builder or corporate entity, occasionally a personal representative’s deed if the property is being sold by an estate. The deed is signed in front of two witnesses and a notary.

    6. Remote signing for out-of-state sellers

    The majority of 30A sellers are out of state. We arrange:

    • Mobile notary in your home market.
    • Remote Online Notarization (RON) where allowed.
    • Overnight FedEx packages with a local notary.

    You typically sign three to five business days before closing and FedEx the originals back. We coordinate the timing so funds and recording line up.

    7. Closing-day execution

    On closing day, AquaRK confirms the buyer’s funds are in escrow, finalizes the ALTA Settlement Statement, records the deed with the Walton County Clerk (typically same day), pays off your mortgage, pays commissions to both brokerages, pays the HOA, surveyor, and other vendors, and wires your net proceeds to the account you pre-verified by phone.

    8. Post-closing follow-through

    After closing we confirm the satisfaction of your mortgage is recorded, deliver final closing documents for your tax records, issue Form 1099-S (or 8288-A for FIRPTA), and remain on call for any post-closing questions.
