Florida documentary stamp tax on family transfers
Florida charges documentary stamp tax of $0.70 per $100 of consideration on every deed transfer. The trap most families fall into: if the property has an existing mortgage and the new owner takes title subject to that mortgage, Florida treats the outstanding mortgage balance as consideration and taxes it. Example: a parent transfers a 30A condo with a $400,000 mortgage to an adult child as a "gift." Stamp tax is owed on $400,000 — that is $2,800 to the Florida Department of Revenue at recording.
